I live in a 6 story building in Brooklyn Newyork. Recently, Ive been calling the landlords office about a leak that has been in my kitchen. It had destoyed my cabinets and a few of my things in the cabinet. In a continous effort, I was ignored. I finally called 311, or the City of Newyork to have them inspect the safety of the cabinets. They finally came and noticed many other violations in my Apt. They changed my cabinets, but they only changed two. I requested to have the 3rd one put in and I was told that it wasnt part of the “deal”. I pay my rent on time and Im not getting assistnace from the govt. Anyway, the landlord sends a letter to my house with the Supt. of the building that stated that I would have to pay a $4.00 increase in my rent for as long as I live there to cover the cabinet. I refused to sign this request. Is this legal for a landlord to deny me what I need for my apt. Can he increase my rent so I can get one cabinet in my kitchen. Im very upset. What can I do.

It sounds like he got fined by the city and is trying to pass the cost on to you by charging you a bit each month. He can’t do that. He can raise your rent when your lease is up if he experienced extra costs. Are you on a monthly lease. If you are, you are vulnerable. If not, refuse to pay it.

Sounds like something is not being told here. It is tough when we only get one side of the story. $4 is not a big deal, when you think that in 6 months time you may be moving if you don’t Cave in to their demands.
I assume there is something in the lease that covers this, or that they are charging for the 3rd cabinet.
I doubt that he got fined by the city if he corrected what was asked. Landlords are allowed a grace period for repairs.
I am a landlord and the city will always find something petty to write up if they show up on a tenant’s request. I’ve had them cite me for no screens on a couple windows, when they were laying on the ground right in front of the unit., And once was written up for a faulty “Fridge” when the electric was not even turned on. Needless to say the inspectors in both cases were very embarrassed when I took photos and shut off statement from utility company to their boss.

He can not raise your rent until your current lease is up. Once the lease renews then yes he can ask for an increase
